Overview

This website is operated by IN2R Clothing & Apparel. Throughout the site, the terms “IN2R,” “we,” “us” and “our” refer to IN2R Clothing & Apparel. We offer this website, including the information, tools, products and services available through it, subject to these Terms of Service and the policies referenced below.

By visiting our website, creating an account, placing an order or otherwise using our services (collectively, the “Service”), you agree to be bound by these Terms of Service. These Terms apply to website visitors, customers, account holders and anyone else who uses the Service.

Please read these Terms carefully before using the website. If you do not agree with these Terms, you should not use the Service or place an order.

Our online store is hosted on Shopify. Shopify provides the e-commerce platform that allows us to offer and sell products and services online.

Nothing in these Terms limits or excludes consumer rights, warranties, remedies or other protections that cannot legally be waived.

Section 1 — Online Store Terms

By using this website, you represent that you have reached the age of majority where you live, or that you are using the website with the permission and supervision required by applicable law.

You may not use the Service or our products for any unlawful or unauthorized purpose. You must not violate applicable laws, infringe intellectual-property rights, interfere with website security or transmit malicious code.

We may restrict or terminate access to the Service where we reasonably believe a user has violated these Terms, engaged in fraud or unlawful conduct, abused the Service, threatened website security or created another legitimate legal or operational risk.

Section 2 — General Conditions

We reserve the right to refuse or cancel service or an order for lawful reasons, including suspected fraud, payment problems, product unavailability, unsupported delivery information, purchase-limit violations, unauthorized resale, obvious pricing or technical errors, or other legitimate business or legal reasons.

You may not reproduce, duplicate, copy, sell, resell, exploit or make unauthorized commercial use of the Service, website content or access to the Service without written permission from IN2R or the applicable rights holder.

The headings in these Terms are provided for convenience and do not change the meaning of the provisions.

Section 3 — Accuracy, Completeness and Timeliness of Information

We make reasonable efforts to keep product information, pricing, availability, shipping information and website content accurate and current. However, errors, delays, outdated information or technical issues may occasionally occur.

Historical, editorial, lifestyle or general informational content may be provided for reference and may not reflect current conditions.

We may update or correct website content when reasonably necessary. Nothing in this section limits our obligations concerning product descriptions, pricing disclosures, consumer warranties or other requirements imposed by applicable law.

Section 4 — Modifications to the Service and Prices

Product prices, availability, collections, promotions and website features may change without advance notice, except where notice or another process is required by law or by the terms of an accepted order.

We may modify, suspend or discontinue products, website features or parts of the Service. Changes do not remove mandatory rights that already apply to an accepted customer order.

Section 5 — Products and Services

Product information

We make reasonable efforts to display product descriptions, photographs, colours, materials, sizing, decoration methods, pricing and other details accurately. Colours and visual details may vary because of screen settings, lighting, photography and normal manufacturing differences.

Product sizing can vary between styles, suppliers and blanks. Customers should review the applicable product description and size guide before ordering.

Product availability

Products, colours, sizes and variants are subject to availability. Adding an item to a cart does not reserve inventory. We may limit quantities, discontinue products, correct inventory errors or remove unavailable products from sale.

If we are unable to fulfill a paid item, we will not intentionally substitute a materially different product without the customer’s approval. The affected item may be cancelled and the eligible amount returned to the original payment method, subject to applicable law.

Made-to-order products

Some IN2R products are identified on the product page as Made to Order. These products are produced after an order is placed and may be manufactured, decorated and shipped by an approved fulfillment partner rather than from IN2R’s Saskatoon on-hand inventory.

Production may begin shortly after an order is accepted. Requests to cancel or change a made-to-order product should be made as soon as possible and cannot be guaranteed after production begins.

Once production has begun, made-to-order products are final sale for voluntary reasons such as change of mind, fit, sizing, colour preference or ordering the wrong item, as described in our Refund & Return Policy. This does not limit mandatory rights relating to defective, damaged, unsafe, misrepresented or incorrectly supplied products.

Fulfillment partners may select a production facility based on factors such as destination, variant availability, decoration method and facility capacity. A made-to-order product may therefore be produced or shipped from a facility outside Canada and may arrive separately from other items in the same order.

Pre-orders and special-order products

Pre-orders are separate from regular made-to-order products. A pre-order is offered during a published order window and follows the opening, closing, cancellation and fulfillment terms displayed on the product page and in our policies.

The published pre-order closing date is the order and cancellation cutoff, not a guaranteed production-completion, shipping or delivery date.

After the order window closes, pre-order items are final sale for voluntary reasons as described in our Refund & Return Policy, subject always to mandatory consumer rights.

Returns and final-sale products

Returns and exchanges are governed by our Refund & Return Policy. Certain products, including headwear, stickers, made-to-order items after production begins, closed-window pre-orders and products clearly marked Final Sale, may not qualify for voluntary returns or exchanges.

Section 6 — Billing, Account Information and Order Acceptance

You agree to provide current, complete and accurate order, billing, contact and delivery information.

An automated order confirmation acknowledges that we received your order. It does not prevent IN2R from reviewing an order before or during fulfillment for product availability, payment authorization, fraud risk, obvious errors, delivery limitations or other legitimate reasons.

We may limit or cancel quantities purchased per customer, household, payment method, billing address, shipping address or order where reasonably necessary. We may also restrict orders that appear to be intended for unauthorized resale.

If we materially change or cancel a paid order, we will make reasonable efforts to contact you using the information provided with the order and will issue any required refund or other remedy.

Payment must be successfully authorized before an order can be processed. Available payment methods are shown at checkout. IN2R does not directly receive or store complete payment-card details entered through Shopify checkout.

Section 7 — Optional Tools and Store Features

The Service may provide access to optional third-party tools, payment features, social features or other services. These tools may be operated by third parties under their own terms, privacy practices and availability conditions.

We may add, modify or remove store features and tools over time. Any new IN2R-operated feature remains subject to these Terms and any additional terms disclosed with that feature.

Section 8 — Third-Party Services, Fulfillment Partners and External Links

IN2R may use third-party service providers to operate the store and fulfill orders, including Shopify, payment processors, manufacturers, print-on-demand and fulfillment partners, carriers, email providers, analytics providers, fraud-prevention services, review tools, advertising platforms and social-media services.

These providers may process information or perform services as needed to support orders and store operations, subject to applicable law and our Privacy Policy.

When a product is sold by IN2R and produced or shipped by a fulfillment partner, your customer-service relationship remains with IN2R. Questions, complaints, defects, damaged items, return requests and fulfillment concerns should be directed to IN2R rather than to the production facility unless we specifically instruct you otherwise.

The website may also contain links to independent external websites. We are not responsible for the content, availability, security, privacy practices, products or services of an independent third-party website merely because we provide a link to it.

Section 9 — Reviews, Feedback and Other Submissions

You may submit reviews, photographs, videos, comments, testimonials, questions, suggestions or other content where the Service permits it.

You are responsible for ensuring that submitted content is truthful, lawful and does not infringe another person’s copyright, trademark, privacy, personality or other rights. You must not submit malicious code, fraudulent reviews, impersonation, unlawful material or content intended to mislead customers.

We may moderate, decline or remove submitted content that violates these Terms or applicable law.

By voluntarily submitting content for publication, you confirm that you own the content or have permission to provide it and grant IN2R a non-exclusive, royalty-free licence to display, reproduce and share the submitted content in connection with the website, products, social-media accounts and marketing, subject to applicable law and any consent choices presented when the content is submitted.

Section 10 — Personal Information

Your submission and our handling of personal information through the Service are governed by our Privacy Policy and applicable privacy law.

Personal information may be collected, used and disclosed for appropriate purposes such as processing and fulfilling orders, providing customer support, preventing fraud, operating accounts, communicating about purchases, complying with legal obligations and sending marketing communications where permitted.

Section 11 — Errors, Inaccuracies and Omissions

Occasionally, the website or Service may contain errors or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, inventory, availability or other information.

We may correct errors and update information when reasonably necessary. If an error materially affects a paid order, we may contact the customer to confirm the corrected information or cancel the affected item and provide the appropriate refund or remedy.

Nothing in this section allows IN2R to avoid consumer rights or obligations that apply under law.

Section 12 — Prohibited Uses

In addition to other restrictions in these Terms, you must not use the website or Service:

• For an unlawful or fraudulent purpose
• To violate applicable federal, provincial, territorial, state, local or international law
• To infringe IN2R intellectual-property rights or the rights of another person
• To harass, threaten, abuse, defame or unlawfully discriminate against another person
• To submit false, fraudulent or misleading information
• To upload or transmit viruses, malware or destructive code
• To collect or track another person’s information without authorization
• To spam, phish, scrape, crawl or probe the Service in a manner that violates law, these Terms or website security
• To bypass or interfere with security, access controls or store operations
• To impersonate another person or misrepresent your identity or authority

We may suspend or terminate access for violations of this section.

Section 13 — Disclaimers and Limitation of Liability

We work to keep the Service available, accurate and secure, but uninterrupted or error-free operation cannot be guaranteed. Website features may be delayed, modified, interrupted or temporarily unavailable because of maintenance, technical issues, service-provider outages, security incidents or circumstances outside our reasonable control.

Production, fulfillment, shipping and delivery estimates are estimates unless expressly stated otherwise. Delays may occur because of product availability, fulfillment capacity, quality control, carrier conditions, weather, customs processing, remote destinations or other circumstances outside our reasonable control.

To the maximum extent permitted by applicable law, IN2R will not be liable for indirect, incidental, special or consequential losses resulting from website use, unauthorized account use, independent third-party services, fulfillment-partner or carrier delays, customs processing, customer-provided address errors or events outside our reasonable control.

Nothing in these Terms excludes or limits liability, warranties, remedies, product-safety obligations, consumer protections or other rights that cannot legally be excluded or limited.

Section 14 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless IN2R Clothing & Apparel and its owners, personnel and service providers from third-party claims, losses or reasonable costs arising directly from your unlawful use of the Service, your material breach of these Terms, or your infringement of another person’s rights.

This section does not require you to indemnify IN2R for losses caused by IN2R’s own unlawful conduct or for liability that cannot legally be transferred or excluded.

Section 15 — Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be limited or severed only to the extent necessary, and the remaining provisions will continue to apply.

Section 16 — Termination

These Terms remain effective while you use the Service.

You may stop using the Service at any time. We may suspend or terminate access where reasonably necessary because of a material breach of these Terms, unlawful conduct, fraud, abuse, security risks or another legitimate legal or operational reason.

Termination does not eliminate obligations, payments, rights or liabilities that arose before termination or provisions that by their nature are intended to continue afterward.

Section 17 — Entire Agreement and No Waiver

These Terms, together with the policies and additional terms incorporated by reference, form the agreement governing your use of the IN2R online store and supersede prior versions relating to the same subject matter.

If IN2R does not immediately enforce a provision, that does not waive our right to enforce it later.

If another IN2R policy contains more specific terms for shipping, returns, made-to-order products, pre-orders, privacy or another subject, the more specific policy will apply to that subject, subject to mandatory law.

Section 18 — Governing Law

These Terms and the use of the IN2R online store are governed by the laws of Saskatchewan and the applicable federal laws of Canada, without limiting any mandatory consumer protection available to a customer under other applicable law.

Section 19 — Changes to These Terms

We may update these Terms when our business, products, fulfillment methods, website functionality, service providers or legal requirements change.

The current version will be posted on this page with an updated date. Changes do not remove mandatory rights or remedies that applied to an accepted order when it was placed.
